2. Property Availability & Booking

3. Rental Terms

The following rental terms are subject to the provisions outlined in the rental agreement and are not all-encompassing. Specific terms and conditions may vary depending on the type of rental (e.g., vacation stay, event, or filming booking).

• Renters are responsible for following all property rules and guidelines provided at the time of booking.
• The maximum allowable occupancy for daytime use is 35 people, including guests, crew, or attendees.
• Overnight occupancy is limited to 10 people across the two homes available for use during specific rental arrangements.
• Cancellations and refund policies will be outlined in the rental agreement and depend on the type of rental.

4. Events & Film Production

• Events and filming must comply with local noise ordinances, with quiet hours starting at 9:00 PM.
• Parking is limited to approximately 10 vehicles. Carpooling is highly encouraged.
• Filming projects may require liability insurance and permits. Permits, if applicable, are the responsibility of the production team to research and obtain.
• Any modifications to the property, set design, or use of stunts, pyrotechnics, or drones require prior written approval.

5. Prohibited Uses

• The property may not be used for illegal activities, unsecured or unsanctioned events, or any activity prohibited by local laws.
• Unauthorized animals, large gatherings exceeding our guest capacity, or unapproved modifications to the property are strictly prohibited.
• We do not sell or provide alcohol. Vacation rental guests are responsible for related compliance and applicable laws.

6. Liability & Damages

• Guests and renters are responsible for any damage to the property or its contents caused by themselves, their guests, or production crews.
• Old West Temecula, LLC, is not liable for injuries, accidents, or losses during your stay or use of the property.
• Liability insurance may be required for events and production bookings to cover potential damages or incidents.

7. Payment Terms

• All payments are due according to the terms outlined during the booking process. Failure to make payment may result in cancellation of the reservation.
• For filming and larger events, additional security deposits may be required to cover potential damages or extra cleaning fees.
• Charges such as cleaning fees, insurance fees, and applicable TOT (transient occupancy tax) will be included in your final booking total.

8. Noise Ordinance & Quiet Hours

Please respect our neighbors and adhere to the local noise ordinance, which requires quiet hours starting at 9:00 PM. Amplified music or loud activities must cease at this time. Failure to comply may result in penalties or immediate termination of your booking without a refund.

9. Cancellations & Refunds

Cancellation policies vary depending on the type of rental (vacation, event, or filming). Specific cancellation terms will be provided in your rental agreement. Any security deposits held for damages will be refunded after inspection of the property, assuming no damage is found.

10. Pets

Old West Temecula has a strict no-pet policy, except for trained service animals. Guests bringing service animals must notify us in advance and ensure the animal is well-behaved and does not cause damage or disturbances.

11. Indemnification

By using our property, you agree to indemnify and hold harmless Old West Temecula, LLC, and its representatives from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from your use of the property or violations of these Terms of Service.

12. Governing Law

These Terms of Service are governed by the laws of the State of California. By using our property or services, you consent to the exclusive jurisdiction of California courts in any dispute arising under these terms.
